A strange question came up last night during a game.

Pedro and some Termies were shot at and they fled. A Dread attempted to assault the unit.

Now, do Marines get the benefit of ATSKNF when they're assaulted while falling back or do they have to roll a Leadership test as normal?

I can't quite remember the reasoning but Pedro & Co had to test and failed again getting destroyed. Apparently it doesn't apply to squads assaulted while falling back but it does in all other circumstances (unless there are enemies within 6").

Anyone got any explanations either way? Cheers.

ALL units always auto-rally if assaulted when falling back. ATSKNF only allows Marines to rally at the start of their turn if there are no enemies nearby.

Darklove wrong, Stormbrow right regarding assaulting units while they're falling back.

That's why you just keep a model within 6" of them as they fall back. That will prevent them from regrouping and you just escort them off the table. Done it many a time with a Chimera driving behind a squad of Marines falling back.

So, in summation, the Marines auto-pass the Regroup check if assaulted whilst falling back. Making it a very dumb move. Just shoot 25% of them and make them run again.
