Default Mortar's and shooting what they can't see.

Alrighty, took a quick glance over the rulebook and the Empire army book for this ruling, but it's late and my brain decided to stop comprehending most things.

Is targeting a unit within 12" with a mortar, and then over guessing to hit some other squad way behind them technically legal? I know they have to be able to draw LoS to the unit they are targeting, but then being able to just "overshoot". Seemed possibly, just completely against the spirit of the game. Especially since the guy was in a sinking ship and just wanted to pop one of my salamanders.

That's one of those issues that comes down to the Honor System. Normally, you wouldn't do that in favor of just playing the game, yet it is an avenue by which many players have weaseled around the rules. It's one thing to be off by a few inches. Twelve inches (30cm)? That's unbelievably inaccurate, and horribly unfair.

it's as Ascendant Valor said, technically it's possible, but it would still be classed as cheating, the same way as declaring an impossible charge to get a friendly unit out of the way of a friendly charging unit is (see the fantasy FAQ page 2).

I believe the rules state something to the effect that you must guess as accurately as possible, so diliberatly overguessing, or targeting a unit you know you couldn't hit, is cheating, however, its a very wishy-washy sort of thing, where you draw the line is not defined at all....

A better thing is just having a house rule - we say if your guess isn't within 8" of the target it's just lost.

Yah... I was actually there for the particular situation that Cougar is talking about, the Empire player picked a unit of Saurus' that was at most 10" away from him and then Guessed 25" which actually managed to kill one of those fire breathing Lizardmen things (don't remember what they're called). But yah, I don't think there is any rule "against it" but in the spirit of the game (especially since yesterdays games was friendly/casual) I don't think it should be allowed. You know I wouldn't try to pull such shenanigans on you Steve. XD
