friend of mine brought up an interesting point. doesn't EA produce GW stuff? they may have permission....?

They have the Warhammer IP through Mythic, but nothing in regards to 40k afaik.

I also doubt GW would happily allow them to use their designs under a different name and IP.

I hated C&C 4, but alliances is kinda like the MMO Global Domination.
